Approval of Amendment No. 2 to Contract No. 050420-Pharmacy Services for Gila County Detention Medical.
Background Information
On September 1, 2020, the Board of Supervisors approved Contract No. 050420-Pharmacy Services for Gila County Detention Medical for the period September 1, 2020, to August 31, 2021. The original contract was executed for a not-to-exceed amount of $75,000 without written authorization from the Board with the option to renew the contract for three additional one-year periods.

On September 7, 2021, the Board of Supervisors approved Amendment No. 1 to Contract No. 050420-Pharmacy Services for Gila County Detention Medical to extend the term of the contract for an additional one-year term, from July 1, 2021, to June 30, 2022.
Evaluation
Amendment No. 2 to Contract No. 050420-Pharmacy Services for Gila County Detention Medical extends the term of the contract for an additional one-year term, from July 1, 2022, to June 30, 2023; and adds to the contract language: Certification of No Forced Labor; The Company does not currently, and agrees for the duration of this Agreement that the Company will not use:

1. The forced labor of Ethnic Uyghurs in the People’s Republic of China.

2. Any goods or services produced by the forced labor of Ethnic Uyghurs in the People’s Republic of China.

3. Any contractors, subcontracts, or suppliers that use the forced labor or any goods or services produced by the forced labor of Ethnic Uyghurs in the People’s Republic of China. 

The Company further agrees that if the Company becomes aware, during the term of the Agreement, that the Company is not in compliance with this Certification, the Company shall notify the County within 5 business days after becoming aware of the non-compliance. If the Company does not remedy the non-compliance within 180-days after sending notice of non-compliance, this Agreement shall automatically terminate.
Conclusion
The Gila County Sheriff’s Office wishes to execute Amendment No. 2 to Contract No. 050420-Pharmacy Services for Gila County Detention Medical with Westwood Pharmacy to extend the term of the contract for one additional year from September 1, 2022, to August 31, 2023; and adds to the contract language: Certification of No Forced Labor.
Recommendation
The Sheriff's Office recommends approving Amendment No. 2 to Contract No. 050420-Pharmacy Services for Gila County Detention Medical, to extend the term of the contract for an additional year, from September 1, 2022, to August 31, 2023, for a total contract amount not to exceed $75,000, and adds to the contract language: Certification of No Forced Labor.
