Adopt Resolution No. 22-07-02 accepting a Quit Claim Deed from Helen R. Groom, establishing Christopher Drive as a Primitive Road; Accepting Christopher Drive into the Gila County Primitive Roads System; and authorizing its Chairman to execute the necessary documents on behalf of Gila County.
Background Information
Christopher Drive was created when Christopher Creek Haven Plat Number Three, Gila County Records Plat No. 201 was recorded in 1958. The dedication for the roads in the subdivision was for the use and benefit of the owners, heirs, and assigns, of the lots and tracts within the subdivision.
Evaluation
The owner of the adjoining land (Groom) has asked Public Works to maintain the road. The owner was informed that without permission or an easement from the owners we could not maintain the road. Ms. Groom was informed that we would need an easement or deed from the subdividers before we could consider maintaining the road. Ms. Groom has found heirs of the Ashby’s who were the original subdividers of Christopher Creek Haven Plat Number Three. They have quit-claimed the road to Ms. Groom as shown on Record of Survey No. 4683. Ms. Groom would like to now quit-claim the road to Gila County.
Conclusion
By accepting this quit-claim deed Public Works will now be able to maintain Christopher Drive. This road connects Christopher Creek Loop to Ashby-Apple Drive, both of which are County maintained roads. Maintenance of this road will allow residents an additional maintained road to enter and exit the area.
Recommendation
It is the recommendation of the Public Works Department Director and the County Engineer to adopt Resolution No. 22-07-02 to accept and record the quit claim deed for Christopher Drive shown as Parcel “B” or Record of Survey Map No. 4683, Gila County Records.
