Adoption of Resolution No. 22-07-01 approving Resolution No. 22-07-01, which would approve Gila County Planning and Zoning Department Case No. CUPG2204-001, an application submitted by Central Heights Baptist Church (Owner) and James Dutcher (Applicant) for a Conditional Use Permit on Assessor's tax parcel number 207-08-011 located at 5459 S. Apache Avenue, Globe, Arizona, and Assessor's tax parcel numbers 207-08-009 and 207-08-010 located at lots 9, 10 and 11 of Block 2 of Central Heights, Globe, Arizona to allow a parking lot for additional church parking subject to the adherence of 7 conditions of approval as outlined in the resolution.
Background Information
The Applicant, Central Heights Baptist Church of Globe, through James Dutcher, a church representative, is proposing to construct new parking facilities for additional church parking on the subject properties owned by the church located in Globe, Arizona.

On May 19, 2022, the Planning and Zoning Commission unanimously voted 5-0 to recommend approval of the application with conditions.
  1. The Gila County Conditional Use Permit is granted to the current owner only and is not transferable.
  2. Construction of the parking facilities shall be in conformance with the Gila County Conditional Use Permit Application dated on April 4, 2022. Additionally, conformance shall apply to any future revised plans submitted to Gila County.
  3. All lighting shall comply with the Gila County Outdoor Light Control Ordinance. Each parking lot light fixture shall be at or under 3,000 Kelvin.
  4. The owner must abide by all other state, federal and local regulations that may be applicable. The owner must obtain any state, federal and local permits that are required.
  5. Assessor’s tax parcel numbers 207-08-009 and 207-08-010 shall have an easement in place from where the utilities start to the end of the utility run, prior to placing any utilities.
  6. The owner is to determine if a crosswalk is required by any state, federal or local requirements. The crosswalk shall be installed prior to the use of the parking area if it is deemed necessary.
  7. A Gila County Development Plan Application shall be submitted and approved showing all uses for the parking area prior to the use.
Case No. CUPG2204-001 was posted in the Arizona Silver Belt newspaper on April 27, 2022, for the Planning & Zoning Commission's public hearing and on June 8, 2022, for the Board of Supervisors' public hearing. The property was also posted on May 3, 2022, for the Planning and Zoning hearing and June 15, 2022, for the Board of Supervisors' hearing. In addition, a public participation meeting (citizen review process) was held on May 2, 2022, with 1 person attending.
Evaluation
According to Staff research, the Church predates the Gila County Zoning Ordinance which was adopted by the Board of Supervisors in 1959. Additionally, research indicates that when the code was adopted in 1959, churches and ancillary uses located within the Residence One (R1) District were required to obtain Conditional Use Permit approval. The Church acquired subject properties APN: 207-08-009 and 207-08-010 in July 2020. Subject property APN: 207-08-011 is included due to the location of electricity. The properties will be combined in the future.

The two (2) subject properties where the proposed parking facilities will be constructed are vacant and have recently been cleared, grubbed, and graded. Subject property APN: 207-08-011 is where the power is located, and power will be pulled for the light poles which will be located in the proposed parking area. Access to the proposed parking area is off Apache Avenue with separate ingress and egress design for safety. Approximately 24 parking spaces will be available upon completion of the project.
Conclusion
In reviewing the Conditional Use Permit application for recommendation, Staff considers the County Ordinance, zoning, the current and proposed land use of the property, adjacent property owner comments, and if the land use will be compatible and harmonious with the legal neighboring uses.

In reviewing the considerations stated above, the Church has been in this residential community prior to the adoption of the Gila County Zoning Ordinance. Churches and ancillary uses are allowed in the Residence One (R1) District with an approved Conditional Use Permit. To date, no complaints have been received. Additionally, no concerns have been received in regard to this application.
Recommendation
Staff recommends that the Board of Supervisors conducts the public hearing and after the public hearing considers adopting Resolution No. 2022-07-01 with conditions outlined in the staff report presented to the Board and attached to this agenda item.
