Request to ratify the Board's approval of a three-year contract signed by the County Manager for John S. Perlman, Attorney at Law representing the Public Fiduciary on probate matters.

Background Information

The Public Fiduciary's Office requires legal advice and representation regarding probate, guardianship, and conservatorship matters. John S. Perlman is a local attorney capable and qualified to perform such services. The term of the contract is three years with a provision for two additional one-year renewal periods. The rate of service is $175 per hour to generate pleadings pertinent to Guardianship, Conservatorship, and probate matters. The contract also allows a rate of $85 per hour for travel time. The contract request was written for an annual amount not to exceed the fee of $25,000; however, upon further review by the County Attorney's Civil Deputy the value of the contract exceeds the County Manager's authority. The total initial term contract is $75,000 which spans the three-year period.

Evaluation

The contract for an attorney is necessary for the Public Fiduciary's Office to conduct their business and Attorney John S. Perlman is capable and qualified to perform the scope of work.

Conclusion

It is in the best interest of the Public Fiduciary's Office for the Board to ratify the contract with John S. Perlman, Attorney at Law, as written.

Recommendation

Staff recommends that the Board of Supervisors ratify its approval for the County Manager's signature on the contract that is attached to this agenda item.
