Public Surplus Online Auction of Properties Deeded to the State of Arizona c/o Board of Supervisors by the County Treasurer in 2020 |
Background Information |
Arizona Revised Statutes (A.R.S.) § 42-18301 through 42-18303 outlines the procedures related to the responsibilities of a county board of supervisors once the county treasurer deeds the property to the state of Arizona in care of the board of supervisors.
In 2020, the Gila County Treasurer deeded 16 properties to the State of Arizona in care of the Gila County Board of Supervisors. As allowed by statute, one property (tax parcel number 207-15-296) was sold to the City of Globe before the auction to be used for a public purpose related to transportation or flood control. One other property (tax parcel number 304-17-084B) was offered to the Town of Payson before the auction; however, the Town declined to purchase the property. This property is part of a road traversed by several property owners, so it was removed from the auction list leaving 14 properties available for sale.
The Board of Supervisors did not conduct a live auction for those properties newly deeded to the State of Arizona in care of the Board of Supervisors in 2020 due to the COVID-19 pandemic. After considering the options, the Clerk of the Board determined that having an online auction would be the best solution and the County Manager agreed. The County has used Public Surplus in the past to conduct various auctions, so it was decided to utilize Public Surplus to sell these state tax-deeded properties. |
Evaluation |
Per statutory requirement, the list of properties to be sold was prepared "on or before the first Monday in November." On April 5, 2021, the list and information was placed for viewing on the County's website; it was published in the Arizona Silver Belt and Payson Roundup newspapers; and a hard copy was made available to the public at the Board of Supervisors' receptionist's office.
On behalf of the Board of Supervisors, Public Surplus held an online auction to sell the 14 properties that were deeded to the State of Arizona in care of the Board of Supervisors in 2020. The auction began on April 19, 2021, and ended on May 2, 2021. Of the 14 properties listed for sale, 8 were sold.
The following properties were submitted to the online auction: 101-07-165, 101-07-306, 101-09-111A, 101-13-025, 206-03-213, 206-18-047, 206-21-014, 206-21-190, 207-04-081B, 207-09-122, 207-18-054, 207-28-075, 208-02-499A, and 301-59-012D. |

A total of $69,799.05 was collected and deposited with the County Treasurer on June 9, 2021. This resulted in a net profit of $48,061.74 over the lien amount, and the 8 properties are once again on the tax rolls.
Part of the internal process for the sale of these auctioned properties is to submit Quit Claim Deeds to the Board of Supervisors with a request for the Board Chairman to sign them, which will finalize the sale of the properties. The 8 Quit Claim Deeds need to be signed and then they will be recorded. The recorded Quit Claim Deeds will be mailed to the new owners. |
Recommendation |
The Clerk of the Board recommends that the Board of Supervisors authorize the Board Chairman to sign the Quit Claim Deeds for the sale of tax parcel numbers 101-09-111A, 206-03-213, 206-18-047, 206-21-014, 207-09-122, 207-18-054, 207-28-075, and 208-02-499A. |
