Approve Intergovernmental Agreement (IGA) No. 07012020 with the Town of Payson to provide common administration for the Town of Payson Municipal and Payson Regional Justice Courts.

Background Information

The Payson Regional Justice Court and Town of Payson entered into an IGA on May 14, 1999, to provide limited jurisdiction court services. The IGA has since expired and a new IGA was prepared for consideration. The new IGA that was developed takes into consideration the actual costs to run the Magistrate Court administration instead of a per case fee. The new IGA was reviewed and approved by Judge Timothy Wright and approved by the Town of Payson and is consistent with the other limited jurisdiction court IGAs within Gila County.

Evaluation

A calculation of the space, materials, and services was identified, and all parties agreed to this method of valuation starting on July 1, 2020.

This IGA will commence on July 1, 2020, through June 30, 2022, with a one-year renewal option. The Town agrees to pay the County a sum of $128,249.58 for the first year in 12 monthly installments of $10,867.47. In February of each year of the Agreement during the initial term and any extended term, the County will review and provide notice to the Town of the annual fee to be charged to the Town for the next year beginning July 1st of such year according to the agreed-upon formula.

Conclusion

The new IGA provides consolidated administration and operation of limited jurisdiction courts.

Recommendation

Staff recommends approval of the new IGA No. 07012020 as presented for consolidated administration and operation of limited jurisdiction courts.
