Amendment No. 2 to Intergovernmental Agreement (IGA) No. 121117 with the Town of Winkelman regarding building and zoning review and inspection services.
Background Information
On March 13, 2018, the Board of Supervisors approved IGA No. 121117 with the Town of Winkelman for building and zoning review and inspection services.

Amendment No. 1 to the IGA was approved by the Board of Supervisors on May 7, 2019, to extend the term of the IGA for one additional year, from March 12, 2019, to March 11, 2020; and to remove the language "ISRAEL BOYCOTT CERTIFICATION: Contractor hereby certifies that it is not currently engaged in and will not, for the duration of this agreement, engage in a boycott of Israel as required by A.R.S. § 35-393.01. Violation of this certification by Contractor may result in action by County up to and including termination of this agreement.”

The Town does not have building or zoning inspectors on staff. In order to comply with state statutes and the Town’s ordinances in regard to fire, health, and life safety, the Town requires technical assistance in the areas of inspections and code compliance. The Gila County Community Development Department shall provide field inspections and reports to ensure compliance with state statutes and the Town’s ordinances. The Town shall compensate the County for services provided at the rate of $50 per inspection or $50 per hour for services rendered.
Evaluation
Amendment No. 2 extends the term of the IGA for one additional year, from March 12, 2020, to March 11, 2021.

The Gila County Community Development Department has trained personnel with inspection and code compliance experience whereas the Town does not. The Town is very interested in pursuing code compliance violations and with the assistance of the County, a determination can be made if there is actually a violation. The Town will then pursue enforcement of the confirmed violations.
Conclusion
Approval of Amendment No. 2 will be a benefit to the Town of Winkelman since the County has the resources and expertise in inspections and code compliance that the Town does not. The added workload to the staff of Community Development is expected to be minimal. Staff recommends the approval of this IGA.
Recommendation
The Community Development Department Director recommends the approval of Amendment No. 2 to IGA No. 121117 with the Town of Winkelman.
Suggested Motion
Approval of Amendment No. 2 to Intergovernmental Agreement (IGA) No. 121117 with the Town of Winkelman to extend the contract term for an additional year to March 11, 2021 to continue providing building and zoning review and inspection services to the Town.
