Adoption of Claims and Service of Process Policy No. BOS-COB-005

Background Information

The Clerk of the Board accepts service of notice of claims, summons, complaints, subpoenas, garnishments, tax appeals, and other appropriate legal documents for Gila County, Gila County Board of Supervisors, or the Clerk of the Board. Procedures have been in place for many years; however, a policy relating to claims and service of process has not been formally adopted by the Board of Supervisors.

Evaluation

It is important for the Board of Supervisors to adopt Policy No. BOS-COB-005-Claims and Service of Process to ensure that all claims and other service of process filed upon Gila County or the Clerk of the Board are received, logged and distributed in a manner to ensure compliance with the Arizona Revised Statutes.

Written procedures are attached to the policy. These are departmental procedures relevant to the Clerk of the Board's Department, so they may change from time to time.

Conclusion

The Clerk of the Board has worked closely with Jefferson Dalton, Deputy Gila County Attorney and Civil Bureau Chief, on this policy and related procedures to ensure compliance with the Arizona Revised Statutes.

Recommendation

It is recommended that the Board of Supervisors adopt Policy No. BOS-COB-005.
