Request/Subject
Adoption of Ordinance No. 2022-02 provides for revisions to the Gila County Zoning Ordinance ("Ordinance") for Unincorporated Areas of Gila County by revising the definition of yard, defining the maximum allowable building or other structure height; describing the process to request approval to exceed building or other structure height; clarifying use district setbacks and the process to request approval to encroach in the use district setbacks; allowing for limited accessory structures or buildings that may be located in the front yard with an established principal use; and clarification of demolition permit requirements.
Background Information
The proposed text amendment revisions are to Section 102-Definitions; and Section 103.1-Structures and Uses Compliance to District Requirements.
Evaluation
The proposed Ordinance text amendment revisions revise the definition of yard, define the height of a building or other structure, establish a process to request approval to exceed building or other structure height, clarify the use of district setbacks and process to request approval to encroach in the use district setbacks, allow limited accessory structures or buildings that may be located in the front yard with an established principal use, and clarify demo permit requirements.

A.R.S. § 11-251.05 (C) states, "Prior to adoption, amendment or repeal of an ordinance under this section, the board of supervisors shall hold a public hearing thereon at least fifteen days' notice of which shall be given by one publication in a newspaper of general circulation in the county seat. After adopted or amended, the ordinance shall be published at least once in a newspaper of general circulation in the county seat."

A notice of this public hearing was published in the Arizona Silver Belt newspaper on February 23, 2022.
Conclusion
The Gila County Community Development staff believe that the proposed revisions will allow for clarification and consistency of the Ordinance.

The Gila County Board of Supervisors needs to conduct a public hearing regarding the proposed changes to various sections of the  Ordinance.  To date, no one has submitted written comments, in favor or against, regarding the proposed changes.
Recommendation
On January 20, 2022, the Gila County Planning and Zoning Commission unanimously voted 8-0 to recommend the Board's approval of the Ordinance revisions based on staff’s recommendation.

Information/Discussion/Action to adopt Ordinance No. 2022-02 for text amendment revisions to the Gila County Zoning Ordinance for Unincorporated Areas of Gila County, Arizona, as follows:  Revisions to Section 102-Definitions; and Section 103.1-Structures and Uses Compliance to District Requirements.
