Adoption of Resolution No. 22-03-03 - Gila County Planning and Zoning Department Case No. CUPP2110-001. A request for a Conditional Use Permit to allow for a recreational vehicle on the property prior to the primary residence. The subject property is located at 857 S Tonto Creek Drive, Payson, AZ 85541, APN (Assessor's parcel number): 304-33-386 and is zoned Residence One Density Eight District (R1-D8).
Background Information
A Conditional Use Permit would allow for a recreational vehicle on the property prior to the primary residence. The subject property is located at 857 S. Tonto Creek Drive, Payson, AZ 85541, APN: 304-33-386 and is zoned Residence One Density Eight District (R1-D8).

The applicants, Alan and Robin Warenski, are requesting to place a recreational vehicle on their property prior to their primary residence for a period of 18 months. The applicants reside out-of-state and are estimating monthly visits to meet with contractors to prepare their property for placement of their manufactured home. The applicants' manufactured home will not arrive for approximately 12 months due to the limited supply issue.
Evaluation
Per Section 104.2.A.5.k of the County Zoning Ordinance, Residence One District (Single Dwelling Units) uses subject to a Conditional Use Permit are: "Other uses which can be harmonious or compatible with neighboring uses through the application and maintenance of qualifying conditions.”

Additionally, the Gila County Zoning Ordinance does allow for property owners to apply for a Temporary Use Permit to permit a one-time or short-time use of land for a special event or an interim use subject to conditions. For example, the applicant could obtain a Temporary Use Permit to allow for temporary use of a recreational vehicle for up to six months upon receipt of an approved building permit.
Conclusion
The current land use is primarily vacant with existing electric, water, and wastewater. The Residence One (R1) zoning allows the applicant to apply for a Temporary Use Permit upon approval of a Building Permit; however, the applicant is requesting a time frame of 18 months which exceeds the 6-month duration of a Temporary Use Permit.

Staff finds that the proposed use of occupying the recreational vehicle once or twice a month for a limited time frame to be harmonious and compatible with neighboring uses.
Recommendation
On January 20, 2022, the Planning and Zoning Commission unanimously voted 8-0 to recommend the Board's approval of the Conditional Use Permit application (Case No. CUPP2110-001) with 11 conditions.
Suggested Motion
Information/Discussion/Action to adopt Resolution No. 22-03-03, which approves Gila County Planning and Zoning Department Case No. CUPP2110-001, an application submitted by Alan and Robin Warenski (owners and applicants) for a Conditional Use Permit on Assessor’s tax parcel number 304-33-386 located at 857 S. Tonto Creek Drive, Payson Arizona 85541 to allow for a recreational vehicle on the property prior to the primary residence subject to the adherence of 11 conditions of approval as outlined in the resolution.
