Sale of State-Owned Land Deeded in 2014 Prior to BOS Property Tax Sale/Auction
Background Information
Each year the County Treasurer issues Treasurer's Deeds (TDs) deeding property to the State of Arizona c/o Board of Supervisors when a property owner has not paid property taxes for the past seven (7) years.  After the TDs have been recorded, they are presented to the Clerk of the Board of Supervisors Department along with photos, maps and other pertinent information relating to these properties.

Per A.R.S. § 42-18301 through 42-18304, the Board of Supervisors of the county of which the real property is held by the state under tax deed has authority to sell the property by auction or an online bidding process.  In Gila County, a live auction is held around November or December of each year during a regular meeting of the Board of Supervisors; however, the property tax sale was delayed due to the TDs being presented to the Clerk later than usual.

A.R.S.  § 42-18303(E) states, "The board of supervisors may accept an offer from, and sell real property held by this state by tax deed to, the county or a city, town or special taxing district in the county for a public purpose related to transportation or flood control..."

Years ago, the Board of Supervisors adopted a procedure to sell properties for $1 each to the County or municipalities within Gila County prior to the annual property tax sale/auction when such sale would benefit the entity.  The statute changed a few years ago which enables this same procedure to occur; however, the County, city, town or special taxing district must confirm that the subject property would be used for a public use related to transportation or flood control.
Evaluation
An internal review process was conducted by the Clerk of the Board and the Public Works Division Deputy Director.  Two parcels of land were identified as being needed by the County for a transportation purpose.  These parcels are referred to as Assessor's parcel numbers 102-15-002C and 301-26-044B.  Two other properties were identified as possibly being of interest to the City of Globe for a public purpose related to transportation or flood control.  These parcels are referred to as Assessor's parcel numbers 207-15-033 and 207-15-034.  On February 24, 2015, the Globe City County voted to pursue purchasing these two properties from Gila County.

Arizona state law requires that the Board of Supervisors shall advertise the real property for sale at a public sale; therefore, if the the Board of Supervisors approves the sale of these 4 State-owned parcels of land they will not be advertised in the newspaper.
Conclusion
Steve Sanders, Public Works Division Deputy Director, has identified two parcels of land that the County would like to purchase for a transportation purpose.  Parcel number 102-15-002C is a part of Kellner Canyon Road in Globe.  This parcel was created due to a lot line adjustment.  Parcel number 301-26-044B is a small triangular parcel that is off of South Road in Pine that drops off into Pine Creek.  It is in the area of Pine Creek Drive and Lakeview Drive.

Mr. Sanders also identified parcel numbers 207-15-033 and 207-15-034 that could be used by the City of Globe for a public purpose related to flood control or transportation.  These parcels adjoin one another and consist of possibly a portion of La Mesa Terrace Road and part of a hillside in Globe.
Recommendation
It is recommended that the Board of Supervisors (BOS) authorize the Clerk of the Board to remove the above-named parcels from the upcoming BOS Property Tax Sale/Auction advertisement; proceed with the administrative process of selling the parcels to Gila County and the City of Globe for $1 each; and issue quit claim deeds.
Suggested Motion
Information/Discussion/Action to authorize the Clerk of the Board to remove Assessor's tax parcel numbers 102-15-002C, 301-26-044B, 207-15-033 and  207-15-034 from the upcoming Board of Supervisors' Property Tax Sale/Auction advertisement; authorize the sale of parcel numbers 102-15-002C and 301-26-044B to Gila County for $1 each and the sale of parcel numbers 207-15-033 and 207-15-034 to the City of Globe for $1 each, so that all four parcels can be used for a public purpose for transportation or flood control; and authorize the Chairman's signature on the Quit Claim Deeds.  (Marian Sheppard)
