Approve Amendment No. 1 for Professional Engineering Services under the State of Arizona Procurement Office Contract No. ADSPO18-207044 for flood mitigation design, finalizing plans, specs and bid packages, and additional permitting for three Natural Resources Conservation Service (NRCS) Bush Fire projects in the Tonto Basin area.
Background Information
The Board of Supervisors approved the Professional Engineering Services under the State of Arizona Procurement Office Contract No. ADSPO18-207044 in March 2022 for $165,528 for the final design of projects.

Gila County, JE Fuller, and Associates along with the Natural Resources Conservation Service (NRCS) identified three projects that meet the criteria for funding through the Emergency Watershed Protection (EWP) program. Those areas are Butcher Hook, Landing Wash, and Sycamore Creek.

The NRCS has agreed to fund the construction of the projects. Prior to construction plans, specifications, and bid documents need to be prepared for each project.

Using the State of Arizona Procurement Office Contract No. ADSPO18-207044 with JE Fuller has proposed a final design package for the three chosen NRCS projects which is what is being presented in this meeting.
Evaluation
JE Fuller has already developed 90% plans for the projects. This will allow them to continue working on the plans to develop a complete set for each project. The Department of Forestry and Fire Management (DFFM) has provided funds for 90% of the cost of the plans. A request has been submitted to DFFM asking them to pay for the final plans, specs, and bid documents.
Conclusion
At the initial stage of design and consultation with the US Army Corp of Engineers, there was no concern about obtaining 404 permits. Since then, the US Army Corp of Engineers has decided permitting is necessary to complete these projects. JE Fuller will continue to work with the US Army Corp of Engineers, the US Fish and Wildlife Service, and the Tonto National Forest Service in order to get the required permitting. However, this amount of time was not in their original contract. The contract must be amended to complete the 404 permitting process.
Recommendation
The Public Works Department Director recommends approving Amendment No. 1 to the current contract of JE Fuller/Hydrology & Geomorphology, Inc. to obtain the proper permitting, complete the final design, and develop construction and bid documents for flood mitigation solutions in the three areas in Tonto Basin that are approved by the Natural Resource Conservation Service (NRCS). The additional cost to the contract is $51,310.
Suggested Motion
Approval of Amendment No. 1 for Professional Engineering Services under the State of Arizona Procurement Office Contract No. ADSPO18-207044 with JE Fuller/Hydrology & Geomorphology, Inc. in the amount of $51,310 for a total contract cost of $216,838 to complete the designs, permitting, and developing flood mitigation bid documents for the three high-priority flood projects approved by Natural Resources Conservation Service in the Bush Fire burn scar in the Tonto Basin area.
