Background Information |
Arizona Revised Statutes (A.R.S.) § 42-18301 through 42-18303 outlines the procedures related to the responsibilities of the County Board of Supervisors once a property has been deeded by the County Treasurer to the State of Arizona. Every year the Gila County Board of Supervisors conducts a sale/auction of all properties that have been deeded to the State by the Treasurer in the current calendar year. This sale typically takes place in December. This year's sale is scheduled for Tuesday, December 3rd. |
Evaluation |
According to state statutes, a list of the properties held by the state by tax deed was prepared on or before the first Monday in November. The list includes a full description of each parcel; the name of the former owner, if known; and the total lien amount which includes the total amount of taxes, interest, penalties, fees, and costs, including the unpaid charges of the County Treasurer and Recorder. The list was published on the County's website on November 4, 2019, and advertised in the Arizona Silver Belt newspaper on November 20 and 27, 2019. The list was also made available to the public at the office of the Board of Supervisors on November 4, 2019.
Per the County process, the Engineering Department reviewed all of the newly deeded properties and determined that 5 properties could be used for a public purpose related to flood control or transportation. The Clerk of the Board contacted each of the governmental entities and offered the parcels for sale.
On October 1, 2019, the Board of Supervisors sold tax parcel number 101-10-008 to Gila County and tax parcel number 304-04-222E to the Town of Payson. On October 15, 2019, the Board of Supervisors sold tax parcel number 205-22-010 to the City of Globe, and tax parcel numbers 206-18-023A and 206-18-023B to the Town of Miami. The parcels were sold for a public purpose related to transportation. The agenda items submitted on October 1st and 15th also included a request to authorize the Chairman's signature on the respective Quit Claim Deeds, and remove the parcels from the newspaper advertisement per statutory process, which was approved.
There are 31 remaining properties to be sold at the auction, as follows: 101-07-006, 101-07-106, 101-07-107, 101-07-124, 101-07-138, 101-07-163, 101-07-269, 101-07-281, 101-09-086, 201-06-179D, 203-15-008L, 205-14-034D, 205-18-011, 206-03-101B, 206-06-035A, 206-06-040, 206-06-177, 206-06-178, 206-06-185, 206-06-448, 206-07-008M, 206-09-098, 206-21-086, 206-22-023B, 207-09-075, 207-17-047, 207-20-023C, 208-04-113, 301-03-030, 302-70-273B, and 304-28-005D. |
Conclusion |
All of the applicable statutory requirements have been met with regard to these newly deeded parcels of land; therefore, it is appropriate for the Board to conduct the sale/auction. |
Recommendation |
The Clerk of the Board recommends that a sale/auction of all newly deeded State-owned properties be held during a regular meeting of the Board on Tuesday, December 3, 2019. |
