Arizona Criminal Justice Commission Drug, Gang, and Violent Crime Control Grant Agreement for FY2019 Award Cycle 32 (ACJC #DC-19-004) Amendment.
Background Information
On February 23, 2018, the Gila County Sheriff's Office electronically submitted a grant application to the Arizona Criminal Justice Commission in the amount of $585,045 in order to provide continued funding for the salaries and benefits of the Gila County Sheriff's Office Drug, Gang, and Violent Crimes Task Force. On March 20, 2018, the Board of Supervisor's authorized the electronic submission of the grant application to the Arizona Criminal Justice Commission in the amount of $585,045. On July 10, 2018, the Board of Supervisor's approved Grant Agreement (FY2019 Award Cycle 32-Grant No. DC-19-004) in the amount of $302,320 ($105,812 in federal funds, $120,928 in state funds and $75,580 in matching funds from the County's General Fund) for the performance period of July 1, 2018, through June 30, 2019.
Evaluation
The Amendment to ACJC Grant Number DC-19-004 is as follows:

A.   A local ordinance rule, regulation, policy, or practice (or an applicable State statute, rule, regulation, policy, or practice) must be in place that is designed to ensure that agents of the United States acting under color of federal law in fact are given access to a local government (or local government-contracted) correctional facility for the purpose of permitting such agents to meet with individuals who are (or are believed by such agents to be) aliens and to inquire as to such individuals' right to be or remain in the United States.

B.   A local ordinance, rule, regulation, policy, or practice (or an applicable State statute, rule, regulation, policy, or practice) must be in place that is designed to ensure that, when a local government (or local government-contracted) correctional facility receives from DHS a formal written request authorized by the Immigration and Nationality Act that seeks advance notice of the scheduled release date and time for a particular alien in such facility, then such facility will honor such request and, as early as practicable (see para. 4 of this amendment), provide the requested notice to DHS.
Conclusion
This amendment is required in order to comply with the provisions imposed by the Department of Justice (DOJ) related to notification and access requirements for the Department of Homeland Security (DHS).
Recommendation
It is the recommendation of Sheriff J. Adam Shepherd that the Board of Supervisors approve the Amendment to Grant Agreement No. DC-19-004 between the Arizona Criminal Justice Commission and Gila County Sheriff's Office for the Drug, Gang, Violent Crimes Task Force. The amendment is required in order to comply with the provisions imposed by the Department of Justice (DOJ) related to notification and access requirements for the Department of Homeland Security (DHS).
Suggested Motion
Approval of an Amendment to the FY 2019 Drug, Gang, and Violent Crime Control Grant Agreement (ACJC Grant No. DC-19-004) between Gila County and the Arizona Criminal Justice Commission in order to comply with the provisions imposed by the Department of Justice related to notification and access requirements for the Department of Homeland Security.
