Intergovernmental Agreement (IGA) No. C-50-21-____-X-00, between Maricopa County and Gila County regarding Maricopa County's Sworn and Detention Basic Training Academy.
Background Information
The Gila County Sheriff's Office (GCSO) does not have its own academy and is required to train its Deputy recruits according to the State of Arizona Peace Officers and its Detention Officers. The GCSO contacts agencies as needed throughout the state that operate Basic Training Academies for both Sworn and Detention Officers and requests seats for GCSO Deputy Recruits and Detention Officers to attend. Maricopa County Sheriff's Office (MCSO) Basic Training Academy is one that is utilized as needed by GCSO Deputy Recruits and Detention Officers when space is available. This agreement outlines the responsibilities of MCSO and GCSO regarding the use of MCSO Basic Training Academies for Sworn and Detention Officers. (An agreement number will be assigned to the IGA by Maricopa County once Maricopa County officials have approved the IGA.)

The Gila County Board of Supervisors approved an agreement with MCSO on July 5, 2016, regarding the Detention Officer Training Academy. The Gila County Board of Supervisors also approved an agreement with MCSO on November 17, 2015, and November 13, 2018, regarding the Sworn Basic Training Academy. This agreement renews the Detention Officer Training Academy agreement from July 5, 2016, and supersedes the Sworn Basic Training Academy agreement from November 13, 2018.
Evaluation
Maricopa County Sheriff's Office (MCSO) is responsible for: to provide training space as available for GCSO recruit officers to attend scheduled Sworn Basic Training Academies or Detention Academies, reserves the right in its sole discretion to decide whether the GCSO recruits maintain the academic standings necessary to continue in the Academy class, retains the right, in its sole discretion, to dismiss any recruit for training, academic, ethical or disciplinary standards applicable to all sworn officer training academy participants or detention academy participants, will provide GCSO original individual training records for each GCSO recruit upon completion of the MCSO Academy or termination of the recruit’s attendance at the MCSO Academy. MCSO will maintain records of lesson plans, class rosters, and other documentation common to the class as a whole consistent with the requirements of State law, will treat GCSO recruits in the same manner as MCSO recruits for purposes of training, academics, ethics and discipline, will require GCSO to investigate GCSO recruits should a situation arise for an Internal Affairs Investigation concerning the actions of a GCSO recruit, will bill GCSO Department a non-refundable registration fee per participant as follows: Sworn Academy: $750 and Detention Academy: $250 and will review its costs annually and as needed process amendments to this Agreement for future increases not later than April of each fiscal year, to be effective with the new fiscal year.

Gila County Sheriff's Office (GCSO) is responsible for: Accepts that there is no guarantee that any minimum number of candidates from the GCSO will be accepted to attend the academy, because enrollment is based MCSO’s determination of appropriate space/resource availability and because MCSO candidates have enrollment priority, understands and agrees that the curriculum will consist of the standard MCSO training program for MCSO, including MCSO’s policies and procedures, will provide worker’s compensation insurance, salary, benefits, for GCSO recruits, will provide applicable items including weapons, ammunition and uniforms for GCSO recruits depending on the requirements for the designated academy, sworn basic training or detention basic training, agrees to pay for all employer related costs for its employees as acknowledged in the Independent Contractors section, above, will ensure its employee participants have received infectious disease testing and required immunizations and have undergone health related pre-requisites applicable to MCSO academy attendees prior to the first day of training. Proof of the preceding will be necessary for the participant’s records prior to the academy start and agrees to pay MCSO within 30 days of receipt of invoice.
Conclusion
GCSO utilizes the Maricopa County Sheriff's Office Sworn and Detention Officer training Academy on an as needed basis to assist in the training of the GCSO Certified Deputies and Detention Officers. Following the initial term, this IGA will automatically renew for up to two, one-year terms unless canceled or terminated upon Board of Supervisors approval.
Recommendation
It is the recommendation of Sheriff J. Adam Shepherd that the Board of Supervisors approve the IGA between Maricopa County and Gila County regarding the use of the Maricopa County Sheriff's Office Sworn and Detention Officer Training Academy beginning July 1, 2020 through June 30, 2022.
Suggested Motion
Approval of Intergovernmental Agreement No. C-50-21-___-X-00, between Maricopa County and Gila County regarding the continued use of the Maricopa County Sheriff's Office Sworn and Detention Officer Basic Training Academy for the period of July 1, 2020 through June 30, 2022.
