Request approval of A133-2009 Exhibit A GMP Contract Amendment in the amount of $2,523,672.24 for the construction of the Animal Care and Control Facility. Total GMP for project including pre-construction services $2,563,532.36

Background Information

On December 3, 2019, the Board approved AIA Contracts A-133-2009 Standard Form of Agreement Between Owner and Construction Manager as Constructor and A201-2017 General Conditions of the Contract for Construction to provide pre-construction services and prepare a Guaranteed Maximum Price (GMP) Amendment to build the new Globe Animal Care and Control building and site improvements Animal Care and Control Facility and site improvements in Globe to Loven Construction Contracting, Inc. in the amount of $39,860.12 for pre-construction and a Guaranteed Maximum Price percentage of 5%. Loven has completed the pre-construction services and has prepared the A133-2009 Exhibit A Maximum Price Amendment in the amount of $2,523,672.24 for the construction of the Animal Care and Control Facility and previously approved $39,860.12 for the pre-construction service for a total GMP of $2,563,532.36 per the contract for the Board's review and approval.

Evaluation

All project stakeholders have reviewed the GMP detail and have determined that all aspects of the construction of the new animal care and control facility will be accomplished within the price and the price is within the budgeted capital expenditures for this project.

Conclusion

The new animal care and control facility will be constructed within the project scope as determined by the stakeholders and will be constructed within the budget set forth in the capital plan. Approval of A133-2009 Exhibit A Contract Amendment the amount of $2,523,672.24 for construction and $39,860.12 for pre-construction services for a total GMP of $2,563,532.36.

Recommendation

Staff recommends the approval of the GMP Contract Amendment.
