Amendment to an Intergovernmental Agreement between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College.

Background Information

On April 11, 2005, the Board of Supervisors approved a Settlement Agreement, Operating Agreement, and an Intergovernmental Agreement (IGA) between Gila County; Gila County Provisional Community College District; and Graham County Community College District d/b/a Eastern Arizona College which pertain to post-secondary educational services in Gila County.

On March 31, 2009, the Board approved an Amendment to the Operating Agreement to amend Article IV, paragraph 10 of the Operating Agreement.

On April 28, 2009, the Board approved an Amendment to the IGA to extend the contract for 3 years to June 30, 2018. The Operating Agreement also extended to June 30, 2018, as it provides terms and conditions related to services provided pursuant to the 2005 IGA.

On June 5, 2018, the Board approved an Amendment to the IGA during a regular meeting.

Evaluation

The Gila County Attorney's Office needs the Board of Supervisors' instruction regarding the negotiation of an IGA between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College.

Recommendation

The Gila County Attorney's Office recommends that the Gila County Board of Supervisors vote to go into executive session, under A.R.S. Section 38-431.03(A)(3)-(4), to discuss and consult with its attorneys regarding the 2005 IGA that is between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College, in order to receive legal advice, consider its position and instruct its attorneys regarding negotiations of the IGA.

Information/Discussion/Action to vote to go into executive session pursuant to A.R.S. Section 38-431.03(A)(3)-(4) to discuss and consult with the attorneys and the Board of Supervisors regarding the 2005 Intergovernmental Agreement (IGA) that is between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College in order to receive legal advice, consider its position and instruct its attorneys regarding negotiations of the IGA and after the regular meeting has been reconvened, move to direct its attorneys to proceed as directed in the executive session regarding this agenda item.
