Corrective Memorandum of Ground Lease Agreement with NCWPCS MPL 24-Year Sites Tower Holdings LLC.

Background Information

On June 5, 2018, the Board of Supervisors approved the Ground Lease Agreement with NCWPCS MPL 24-YEAR SITES TOWER HOLDINGS LLC. In reviewing the agreement, the Commencement Date showed June 5, 2018 with a termination of June 4, 2043. Since “Commencement Date” means the first day of the month following the month in which the Agreement was fully executed, the Commencement Date should have been July 1, 2018, with the final lease expiration of June 30, 2043.

Evaluation

The Commencement Date needs to show July 1, 2018 with the final lease expiration of June 30, 2043.

Recommendation

Gila County Public Works recommends approving the Corrective Memorandum of Ground Lease Agreement with NCWPCS MPL 24-YEAR SITES TOWER HOLDINGS LLC correcting the effective dates from June 5, 2018 – June 4, 2043 to July 1, 2018 to June 30, 2043.

Suggested Motion

Approval of a Corrective Memorandum of Ground Lease Agreement with NCWPCS MPL 24-YEAR SITES TOWER HOLDINGS LLC, which corrects the effective dates of the Agreement from June 5, 2018 to June 4, 2043, to July 1, 2018 to June 30, 2043.
