Request/Subject

Set a Public Hearing Date for Deannexation/Annexation for Towns of Star Valley and Payson.

Background Information

On August 8, 2014, the Gila County Clerk of the Board (COB) received an email from Tim Wright, Town of Payson Attorney, advising the County that the Town of Star Valley and Town of Payson are collaboratively working to deannex 760 acres of Forest Service land from Star Valley into Payson.

A.R.S. §9-471.02 provides the requirements for deannexation/annexation of land from one municipality to another municipality.

In accordance with statutory requirements, on August 13, 2014, the Town of Star Valley filed Ordinance No. O 14-02 with the COB, and August 15, 2014, the Town of Payson filed Ordinance No. 853 with the COB.

Evaluation

Ordinances were adopted by the Mayors and Common Councils of the Towns of Star Valley and Payson and they were filed with the COB in accordance with statutory requirements.

The next step in the statutory process is for the Board of Supervisors to establish a public hearing date, after which the Town of Star Valley and Town of Payson will be provided notice of said public hearing. A.R.S. §9-471.02(D) states, "The ordinance passed by each governing body shall be filed with the board of supervisors which shall set a hearing date of not less than thirty nor more than sixty days from the date of the filing of the ordinances and shall notify the governing body of each city or town of the hearing date at least thirty days prior to the date."

Conclusion

It is now the time for the Board of Supervisors to set a public hearing date to consider deannexing 760 acres of Forest Service land from the Town of Star Valley to the Town of Payson.

Recommendation

It is recommended that the Board of Supervisors set a date of Tuesday, September 16, 2014, to hear public comments with regard to requests of the Town of Star Valley and Town of Payson for said deannexation/annexation of land as specified in the ordinances submitted by both Towns.

Suggested Motion

Information/Discussion/Action to set a date of Tuesday, September 16, 2014, whereby the Board of Supervisors will hold a public hearing to obtain comments to consider adopting an Order to deannex 760 acres of Forest Service land from the Town of Star Valley and to annex that land to the Town of Payson per the requests of both Towns.
