Approve Intergovernmental Agreement (IGA) No. 060119 with the Town of Star Valley to provide common administration for the Town of Star Valley Municipal and Payson Regional Justice Courts and the repayment of the outstanding balance owed to Gila County by the Town of Star Valley.

Background Information

The Payson Regional Justice Court and Town of Star Valley Municipal Court IGA No. 030614 expired in 2017 and, at that time, the Town of Star Valley had an outstanding past due balance owed to Gila County. A new IGA was developed that takes into consideration the actual costs to run the Magistrate Court administration instead of a per case fee. The new IGA also includes a clause for the Town to pay off the outstanding past due balance as of June 30, 2019. The new IGA was reviewed and approved by Judge Timothy Wright and approved by the Town of Star Valley.

Evaluation

A calculation of the space, materials and services were identified, and all parties agreed to this method of valuation starting in FY 2019. The Town of Star Valley was presented a past due amount of $105,860.84 to be invoiced to the Town upon approval of the new IGA.

Conclusion

The new IGA to provide consolidated administration and operation of limited jurisdiction courts is drafted and includes repayment of the past due amount.

Recommendation

Staff recommends approval of the new IGA No. 060119 as presented for consolidated administration and operation of limited jurisdiction courts and repayment of past due amount.

Suggested Motion

Information/Discussion/Action to approve Intergovernmental Agreement (IGA) No. 060119 with the Town of Star Valley for Consolidated Administration and Operation of Limited Jurisdiction Courts which includes the repayment of the past due amount of $105,860.84 owed by the Town of Star Valley; and authorize the Chairman's signature on the IGA.
