CSL Payson, LLC. appealed the Tax Year 2014 assessed property valuation for property it owns in Payson (the Majestic Rim Senior Living Facility). The Assessor’s Office, and County Attorney’s Office have negotiated a proposed settlement of that appeal subject to Board of Supervisors’ approval.

Background Information

Evaluation

The proposed settlement would resolve the tax appeal. The Gila County Assessor’s Office has reviewed the proposed settlement. The Board has the authority to either approve or reject the proposed settlement. If the Board rejects the settlement, the County Attorney’s Office would then prepare for trial in Arizona Tax Court.

Conclusion

The Board may either approve or reject the proposed settlement.

Recommendation

The Gila County Attorney’s Office recommends approval of the proposed settlement agreement.

Suggested Motion

Information/Discussion/Action to approve a proposed settlement agreement (Stipulated Judgment) between CSL Payson, LLC and Gila County which would resolve the tax appeal CSL Payson, LLC. v. Gila County, NO. TX2014-000308. Pursuant to A.R.S. § 38-431.03(A)(3)-(4), the Board may vote to go into executive session to receive legal advice from its attorney or to instruct in order to consider its position and instruct its attorney to resolve the litigation.
