Request/Subject

Adopt Resolution No. 15-08-01 accepting a roadway easement for a portion of Bixby Road described in Fee No. 2015-005442, Gila County Records, and accepting the road into the Gila County Maintained Roadway System.

Background Information

Bixby Road as described in Fee No. 2015-005442 crosses BHP Copper Inc. property. This portion of Bixby Road used to be SR 88 (now re-named SR 188). During the 1970s SR 88 was relocated and the existing roadway was given back to existing property owners of the underlying land. The two land owners at the time were Inspiration Consolidated Copper Co. (currently FMI) and Pinto Valley Copper Co. (currently BHP Copper). Inspiration granted and recorded an easement to the County for the portion of Bixby Road across their property. An easement for the portion of Bixby Road on Pinto Valley Copper property was never recorded; however, the County has been maintaining Bixby Road for a number of years without having a dedicated easement.

Evaluation

Bixby Road serves numerous homes and businesses in the Wheatfields area, just north of Globe.

Conclusion

It’s in the best interest of the public that the County accepts the dedication of this portion of Bixby Road and continues to provide maintenance on the road.

Recommendation

It is the recommendation of the Public Works Division Director that the Board of Supervisors adopt Resolution No. 15-08-01.

Information/Discussion/Action to adopt Resolution No. 15-08-01 accepting the grant of a roadway easement from BHP Copper, Inc. for Bixby Road as described in Fee No. 2015-005442, Gila County Records, Gila County, Arizona, and accepting said road into the Gila County Maintained Roadway System.
