Board of Supervisors' Annual Property Tax Sale/Auction of land held by the State under tax deed for properties which were deeded to the State of Arizona by the County Treasurer in 2014.

Background Information

Arizona Revised Statutes (A.R.S.) § 42-18301 through 42-18303 outlines the procedures related to the responsibilities of the County Board of Supervisors once a property has been deeded by the County Treasurer to the State of Arizona. Every year the Gila County Board of Supervisors conducts a sale/auction of all properties that have been deeded to the State by the Treasurer in the current calendar year. This sale typically takes place in November or December. The Treasurer presented the 2014 Treasurer's Deeds to the Clerk of the Board later than usual; therefore, there wasn't sufficient time for the Board to conduct a sale in 2014.

A.R.S. § 42-18303 states, "The board of supervisors may accept an offer from, and sell real property held by this state by tax deed to, the county or a city, town of special taxing district in the county for a public purpose related to transportation or flood control..." On March 17, 2015, the Board of Supervisors authorized the Clerk of the Board to remove four parcels from the list of properties deeded to the State by the Treasurer in 2014. Two parcels were sold to Gila County and two parcels were sold to the City of Globe. All properties will be used for a public purpose related to transportation.

Evaluation

The Board of Supervisors has scheduled its annual property tax sale/auction to take place on Tuesday, August 4, 2015, during a Regular Meeting. A notice of the sale along with a list of available properties has been published in the July 15th, 22nd and 29th editions of the Arizona Silver Belt newspaper, the official newspaper of Gila County for 2015. The list has been published on the County website and the bulletin board on the outside entrance of the Globe Courthouse building. The list was made available to the public at the Board of Supervisors' Office beginning July 15th.

Conclusion

All of the applicable statutory requirements have been met with regard to these newly deeded parcels of land; therefore, it is appropriate for the Board to conduct the sale/auction.

Recommendation

The Clerk of the Board recommends that a sale/auction of all newly deeded State-owned properties be held during a Regular meeting of the Board on Tuesday, August 4, 2015.
