Adoption of Resolution No. 16-04-04 accepting a grant of right-of-way (R/W) from the Arizona State Land Department (ASLD) for a public roadway easement on a portion of Cherry Flats Road as described in ASLD Right-of-Way Document No. 16-117830, and authorizing the Chairman of the Board to execute the right-of-way document on behalf of Gila County.
Background Information
Cherry Flats Road traverses through numerous land owners while providing access to the foothills of the Pinal Mountains and the area south of the Town of Miami.

The Gila County Board of Supervisors adopted Resolution No. 14-02-04, which accepted a right-of-way grant of public road from the Bureau of Land Management for a portion of Cherry Flats road near the previously mentioned grants of easements.

Page Land & Cattle Co. has agreed to pay for all third-party costs including filing fees associated with the acquisition of right-of-way from the ASLD for a public roadway easement on a portion of Cherry Flats Road crossing State land.

Gila County Public Works applied for the right-of-way being granted from the ASLD back in July of 2014. Gila County paid the $500 filing fee for this application.  Page Land & Cattle Co. has reimbursed Gila County for this expense.

Page Land & Cattle Co. has paid for an archeological survey for the portion of Cherry Flats Road on State land as part of the requirements for the ASLD  right-of-way application process.

Gila County paid for an appraisal for the portion of Cherry Flats Road on State land as part of the requirements for the ASLD right-of-way application process.  Page Land & Cattle Co. has reimbursed Gila County for this expense.
Evaluation
The ASLD has accepted our application for grant of right-of-way for a portion of Cherry Flats Road per the terms and conditions as set forth in ASLD Right-of-Way Document No. 16-117830. A one-time rental fee of $5,227 is due to ASLD as part of the right-of-way agreement.
Conclusion
Acceptance of the grant of right-of-way from ASLD will allow Gila County to provide roadway maintenance for a portion of Cherry Flats Road.
Recommendation
It is the recommendation of the Public Works Division Director that the Board of Supervisors adopt Resolution No. 16-04-04 accepting the grant of right-of-way from the Arizona State Land Department (ASLD) for a public roadway easement on a portion of Cherry Flats Road as described in ASLD Right-of-Way Document No. 16-117830.

It is also recommended that payment be issued to the Arizona State Land Department in the amount of $5,227 for the rental fee associated with the grant of right-of-way.  Once payment is issued to ASLD, Gila County Public Works will seek reimbursement from Page Land & Cattle Co. for this expense.
