Request/Subject

Adoption of Resolution No. 16-04-05 designating portions of Cherry Flats Road as a primitive road, and authorizing the Board of Supervisors' Chairman to sign the primitive road easements.

Background Information

Cherry Flats Road traverses through numerous land owners while providing access to the foothills of the Pinal Mountains and the area south of the Town of Miami. Gila County Public Works received a Citizens' Petition to establish a portion of Cherry Flats Road as a primitive road. Gila County Public Works received grants of easements for portions of Cherry Flats Road for the purpose of establishing these sections as a primitive road. On February 18, 2014, the Board of Supervisors adopted Resolution No. 14-02-04 accepting a right-of-way grant of a public road from the U.S. Department of the Intererior, Bureau of Land Management (BLM) for Serial No. AZA-36409, also known as Cherry Flats Road near the previously mentioned grants of easements.

The Arizona State Land Department (ASLD) has recently granted Gila County a right-of-way for a portion of Cherry Flats Road near the previously mentioned grants of easements and the BLM grant of right-of- way. (see agenda item ARF-3651 April 5, 2016 meeting).

Evaluation

The petition and grant of easements for portions of Cherry Flats Road meet the requirements of Public Works Policy No. ENG03-03 “Guidelines to Primitive Roads.”

Conclusion

Acceptance of these primitive road easements will allow Gila County to provide maintenance to these portions of Cherry Flats Road as described in the “Guidelines to Primitive Roads.”

Recommendation

It is the recommendation of the Public Works Division Director that the Board of Supervisors adopt Resolution No. 16-04-05 accepting the grants of primitive road easements for portions of Cherry Flats Road.

Suggested Motion

Information/Discussion/Action to adopt Resolution No. 16-04-05 accepting portions of Cherry Flats Road to be established as a primitive road, and authorizing the Board of Supervisors' Chairman to sign the primitive road easements. (Steve Sanders)
