Consideration of the Arizona Attorney General's proposal to resolve an alleged violation by Gila County of A.R.S. Section 11-410.

Background Information

On June 19, 2018, the Gila County Board of Supervisors adopted Resolution No. 18-06-03 which addressed the "Clean Energy for a Healthy Arizona" ballot initiative that was on the ballot for November 2018.

On October 25, 2018, the Board of Supervisors received notification from the Office of the Arizona Attorney General that adoption of that resolution may have violated Arizona Revised Statute § 11-410.

Subsequently Gila County rescinded Resolution No. 18-06-03 by adopting Resolution No. 18-10-05.

Evaluation

The Arizona Attorney General has submitted a proposal to the Gila County Attorney to resolve the matter.

Conclusion

The Arizona Attorney General's proposal should be considered by the Gila County Board of Supervisors in executive session under A.R.S. Section 38-431.03(A)(3) and (4).

Recommendation

The Gila County Board of Supervisors ought to consider the Arizona Attorney General's proposal to resolve the matter in executive session.

Information/Discussion/Action: The Gila County Board of Supervisors may hold an executive session under A.R.S. Section 38-431.03(A)(3) and (4) to consider the Arizona Attorney General's proposal to resolve Gila County's alleged violation of A.R.S. Section 11-410. (Jefferson Dalton)
