Sale of State-Owned Parcel No. 101-10-009 to Gila County.
Background Information
Assessor's parcel number 101-10-009 was deeded to the State of Arizona by the County Treasurer in 2012 because the previous owner did not pay the property taxes for seven consecutive years.  This property is located at 637 Hwy 177, Hayden, and it is the former Hayden motel.  It did not sell at the Board of Supervisors' annual auction, which was held in December 2012.  Over the years, the building has become dangerously dilapidated and considered a hazard to the health and safety of the citizens in the area.

In 2018, Supervisor Cline and his Executive Assistant Cathy Melvin gathered information on this property and submitted a written request for assistance and documentation in the form of pictures of the subject property to the staff of Governor Ducey.  The Governor's Office contacted the Arizona Department of Revenue (ADOR) and the Arizona Department of Environmental Quality (ADEQ) to research this property and work with Gila County staff to review the property ownership and condition.  It was determined that the property should have a lead based paint and asbestos survey conducted as soon as possible.  Travis Barnum with ADEQ was charged with expediting the process and provided a Brownfields State Response Grant Application form to County staff to request the funding to conduct the lead and asbestos survey.  The application was submitted by the County to ADEQ and approved, and a contract was developed and submitted to Gila County.

On January 8, 2019, the Board of Supervisors approved Contract No. ADEQ19-BF1909 with ADEQ; whereby ADEQ provided funding in the amount of $13,000 for ADEQ to provide the lead and asbestos survey for the vacant building on behalf of the Gila County Board of Supervisors.  The asbestos and lead survey and oversight was performed in accordance with the National Emissions Standard for Hazardous Air Pollutants (NESHAP) program.  ADEQ hired a contractor to perform the lead based paint and asbestos survey.  The contractor began the survey on the building; however, it was not completed due to the inability to access the second story of the building as the structure is dangerously unstable.  The survey results that were gathered are still being assessed.  Upon ADEQ hearing about the dangerous condition of the building, this project was elevated to a higher level.  ADEQ informed the County that the building needs to be demolished.  In order to apply for additional Brownsfield State Response Grant funding to have the building demolished, the County needs to own the building.

If the Board of Supervisors approves the sale of this parcel to the County, another Brownsfield State Response Grant Application will be submitted to ADEQ to obtain the funding for a contractor to demolish the building. If a grant is awarded, ADEQ will perform the project management for the building demolition and hire the contractor.
Evaluation
A.R.S. § 42-18303 (E) states, "The board of supervisors may accept an offer from, and sell real property held by this state by tax deed to, the county or a city, town or special taxing district in the county for a public purchase related to transportation or flood control.  The board of supervisors shall convey the deed and apportion the monies received in the transaction prescribed by this action."

Once the building has been demolished, the County intends to use the property for a public purpose related to transportation in coordination with the Town of Hayden.
Conclusion
If the Board of Supervisors approves the sale of this property to the County, another application may be submitted to ADEQ for additional Brownsfield State Response Grant funding to ultimately have the building demolished.  
Recommendation
It is recommended that the Board of Supervisors sell the subject property to Gila County for $1.00.
Suggested Motion
Information/Discussion/Action to approve the sale of Assessor's tax parcel number 101-10-009 to Gila County to be used for a public purpose related to transportation pursuant to A.R.S. § 42-18303; and authorize the Chairman's signature on the related Quit Claim Deed.  (Supervisor Woody Cline)
