Arizona Water Company - Application for Franchise Renewal

Background Information

On June 18, 2002, the Board of Supervisors issued a franchise to Arizona Water Company for a period of 15 years.

Arizona Water Company has submitted an application to the Board of Supervisors for a 25-year renewal of its franchise with Gila County. The $350 application has been received and deposited with the County Treasurer.

Evaluation

Arizona Revised Statute § 40-283 (E) states, "A board of supervisors, before granting any of the privileges authorized under this section, shall give public notice of its intention to make such grant by publishing notice in a newspaper of general circulation, published within the county, at least once a week for three weeks prior to the day set for consideration of such action. If, on or before such date, more than fifty per cent of the qualified electors of the county petition the board of supervisors to deny such privilege, it shall do so, and any privilege granted against such petition shall be void."

Conclusion

The Board of Supervisors needs to accept the application from Arizona Water Company and set a date for the public hearing, at which time the Board will consider renewing the franchise for 25 years.

Recommendation

Arizona Water Company has submitted its franchise renewal application in accordance with Resolution No. 16-12-01, which outlines the regulations for utility franchise applications, The Clerk of the Board of Supervisors has verified that Arizona Water Company has met all application requirements for the 25-year renewal of its franchise with Gila County. Per statute, the Board needs to set a public hearing date after which a public hearing notice will be published in the Arizona Silver Belt newspaper, the official newspaper of the County for 2017, once a week for three weeks prior to the hearing.

Suggested Motion

Approval to accept an application from Arizona Water Company to renew its franchise with Gila County for an additional 25 years, and set a public hearing date of Tuesday, May 9, 2017, at 10:00 a.m. at which time the Board will consider granting said franchise.
