Adoption of Resolution No. 17-04-01 regarding the Canyon River Ranch Domestic Water Improvement District (CRRDWID) Board of Directors.

Background Information

The CRRDWID was formed by a resolution of the Board of Supervisors on June 19, 2007. In 2014, the governing board of CRRDWID became ineligible to serve as governing board members of the district. The CRRDWID governing board members lost title to the parcel which compromised the CRRDWID. As the governing board members neither live or own property any longer in the CRRDWID, they fail to be qualified electors. The CRRDWID is without a quorum and lacks the ability to create a quorum; therefore, it is necessary for the Gila County Board of Supervisors to revoke the authority of the CRRDWID Board of Directors and to govern the CRRDWID as its Board of Directors.

Evaluation

Arizona Revised Statute §48-1016 provides the Board of Supervisors with the statutory authority to take action with regard to the CRRDWID.

Conclusion

Arizona Revised Statute §48-1016 authorizes that the Board of Supervisors "may at any time revoke the authority of an elected board of directors in order to protect the residents of the district."

Arizona Revised Statute §48-1016 and §48-908 gives the Board of Supervisors authority to revoke the power of the CRRDWID governing board and to govern the CRRDWID as its Board of Directors.

Recommendation

The Elections Department recommends that the Board of Supervisors adopt Resolution No. 17-04-01.

Information/Discussion/Action to adopt Resolution 17-04-01 revoking the authority of the Canyon River Ranch Domestic Water Improvement District (CRRDWID) Board of Directors; and naming the Gila County of Supervisors as the Board of Directors for the CRRDWID. (Eric Mariscal/Jeff Dalton)
