Adoption of Resolution No. 14-03-06 for a Roadway Exchange
Background Information
Numerous public roads in the lower Miami and Claypool area have never been formally dedicated to the County. The roads were built outside of platted rights-of-ways on mine-owned property. At the same time many mine-owned homes were built in platted rights-of-ways dedicated to the County. Some platted rights-of-way cannot be used for roads due to the topography of the area. In 1984, Inspiration Consolidated Copper Co. (ICCC) contacted Gila County about dedicating rights-of-ways in the lower Miami and Claypool area. Talks resumed again in 1986 between ICCC and the County with specific roads being mentioned, but nothing progressed other than discussions. In 2009, Freeport McMoRan (FMI), current owners of the mine and land in the area, approached the County about the roads and a joint project to identify and dedicate the roads. Up to now the mine had been the lead agency on the project. Gila County agreed to participate and provide survey information for the project.
Evaluation

The project is now complete with numerous roads and rights-of-way being identified for exchange. During the course of the project BHP Copper Co. was identified as owning some of the roads in the area. BHP was contacted and they agreed to participate in the roadway exchanges. If the County holds rights-of-way on the roads it will allow more flexibility in providing maintenance on the roads. Removing existing platted roads that have never been built nor can be built do to the topography of the land will add property to the tax rolls and generate revenue for the County.

Conclusion
This seems to be a win-win situation for everyone involved. The County will hold rights-of-way on roads currently being maintained by the County and FMI and BHP will receive platted roadways that will be added to the tax rolls.
Recommendation
It is the recommendation of the Deputy Director of Public Works that the Board adopt Resolution No. 14-03-06 authorizing the Chairman to sign quit claim deeds for the exchange of roadways in the lower Miami and Claypool area of Gila County.
Suggested Motion
Information/Discussion/Action to adopt Resolution No. 14-03-06 for a roadway exchange between Freeport-McMoRan Miami Inc. and Gila County, and to authorize the Chairman's signature on a quit claim deed for said roadway exchange.  (Steve Sanders)
