Approve Intergovernmental Agreement (IGA) with the Town of Miami to provide common administration for the Miami Municipal and Globe Regional Justice Courts and the repayment schedule for the outstanding balance owed to Gila County by the Town of Miami.
Background Information
The Globe Regional Justice Court and Miami Municipal Court IGA No. 101613 expired in 2017 and, at that time, the Town of Miami had an outstanding past due balance owed to Gila County.  A new IGA was developed that takes into consideration of the actual costs to run the Magistrate Court administration instead of a per case fee.  The new IGA also includes a reasonable repayment schedule for the Town to pay off the outstanding past due balance as of June 3, 2014.  The new IGA was reviewed and approved by Judge Timorthy Wright and approved by the Town of Miami.
Evaluation
Meetings were conducted with Gila County Court Administration, Finance and Town of Miami Town Manager to identify a fair method of valuation of service and space provided for the Miami Magistrate Court.  The old method was used for FY2018, so the Town would pay the monthly fee while the remainder of the IGA was being negotiated.  A calculation of the space, materials and services were identified and all parties agreed to this method of valuation starting in FY2019.  The Town of Miami presented a repayment schedule to be included in the IGA that was acceptable to Gila County and thus incorporated into the new IGA.
Conclusion
The new IGA to provide consolidated administration and operation of limited jurisdiction courts is drafted and includes repayment schedule for arrearage.
Recommendation
Staff recommends approval of the new IGA as presented for consolidated administration and operation of limited jurisdiction courts.
Suggested Motion
Information/Discussion/Action to approve Intergovernmental Agreement (IGA) No. 012219 with the Town of Miami for Consolidated Administration and Operation of Limited Jurisdiction Courts which includes the repayment schedule for the past due amount owed by the Town of Miami; and authorize the Chairman's signature on the the IGA.  (Mary Springer)
