Approval of Amendment No. 1 to Professional Services Agreement No. 040512 with ATL, Inc.

Background Information

On May 2, 2012, Gila County entered into a Professional Services Agreement with ATL, Inc. to provide material sampling, testing and inspection services for the Pine Creek Canyon Road Reconstruction Project. The contract was for a total amount of $35,000. The contract term was from May 2, 2012, to December 31, 2012.

Evaluation

During the project there were multiple unforeseen conditions that contributed to the additional cost of the material testing. The extensive utility relocations and lack of cooperation from utility companies caused delays and forced work sequencing to be modified. With the construction work being held up and the work not flowing together on a more even schedule, the need for frequent testing became necessary to ensure the quality of the construction. ATL was working out of Flagstaff and charging a trip charge every time they needed to be on the job, resulting in an increase in cost. Change orders due to unforeseen site conditions also contributed to the increase in the material testing budget. The total overrun on the contract is $8,403. Public Works plans on back-charging the contractor for $2,521 for the testing failures when the specifications were rejected.

The signed Change Order request from ATL in the amount of $8,403 is attached to this Agenda item as is Amendment No. 1 to the Agreement.

Conclusion

The original amount of Professional Service Agreement No. 040512 was for $35,000. Gila County Public Works would like authorization to increase the contract amount for Professional Service Agreement No. 040512, by $8,403, for a new total contract amount of $43,403, for cost overruns. If authorization is granted, an Amendment is attached to this agenda item for the Board's approval.

Recommendation

Gila County Public Works recommends the Board's approval of Amendment No. 1 to Professional Services Agreement No. 040512 with ATL, Inc., to increase the original contract amount of $35,000 by $8,403 for a final total contract amount of $43,403 for the work performed on Pine Creek Canyon Road.
