Set a Public Hearing Date for Deannexation/Annexation for Central Heights-Country Club-Midland City Street Lighting Improvement District and Upper Glendale Street Lighting Improvement District

Background Information

A.R.S. §. 48-906 (D) provides the requirements for additions to and alternations of an improvement district.

On November 13, 2019, Wayne Asberry presented the Clerk of the Board of Supervisors with a petition for the alteration of the Central Heights-Country Club-Midland City Street Lighting Improvement District (SLID) and the Upper Glendale SLID. Mr. and Mrs. Asberry are requesting the respective Boards of Directors of the subject SLIDs to consider deannexing their property located at 5691 S. Glendale Avenue, Globe, AZ (parcel no. 207-09-173) from the Central Heights-Country Club-Midland City SLID into the Upper Glendale SLID.

A.R.S. sect. 48-906 (D)(5) states, "On receipt of a petition for an addition or alteration of a district, the governing body shall set a date for a hearing on the petition not later than forty days after presentation of the petition."

Evaluation

Mr. and Mrs. Asberry jointly own parcel number 207-09-173; both petitions contain their signatures and each petitions is accompanied by legal description and map of the subject property per statutory requirement. The next step in the statutory process is to set a hearing date. The Gila County Board of Supervisors also sits as the governing boards for all street lighting improvement districts in Gila County; therefore, the Board is being asked to set the hearing date.

Conclusion

The Board of Supervisors acting on behalf of the governing boards of the respective SLIDs shall establish a public hearing date, after which Mr. and Mrs. Asberry will be provided notice of said public hearing.

Recommendation

It is recommended that the Board of Supervisors set a date of Tuesday, January 21, 2020, to hear public comments with regard to Mr. and Mrs. Asberry's petition to deannex parcel number 207-09-173 from the boundaries of the Central Heights-Country Club-Midland City SLID and into the boundaries of the Upper Glendale SLID.

Suggested Motion

Approval to set a date of Tuesday, January 21, 2020, whereby the Board of Directors of the Central Heights-Country Club-Midland City Street Lighting Improvement District (SLID) will consider deannexing parcel number 207-09-173 from its District boundaries; and the Board of Directors of the Upper Glendale SLID will consider annexing said parcel into its District boundaries.
