Request/Subject
Public Sale of portions of Verde Lane (aka Roper Lane) on the Verde Glen 3, Plat Map No. 393, Gila County Records. Verde Glen 3 is in the community of Payson.
Background Information
On May 3, 2019, during a regular meeting of the Board of Supervisors, the Board directed staff to begin the process to vacate a portion of Verde Lane. Staff began the necessary notifications and public postings of the Board's decision.

Roper Lane provides access to residents of Verde Glen 3. At the southern end of the subdivision, Roper Lane ends at the Tonto National Forest. Visitors to the Forest have tried to continue Roper Lane onto Tonto National Forest land and create roads where no roads exist. There are two existing Forest roads within 500 feet of Roper Lane that provide access to the Forest. In addition to attempting to access the Forest, visitors are turning around in residents yards and damaging private property adjacent to Roper Lane.

There are two (2) adjacent owners at the end of Roper Lane. Both landowners have been contacted and given the option to exercise preference rights before the proposed date of sale or appear at the public sale and submit a bid for the portion adjacent to their property.

The adjacent landowners have submitted bids for portions of Roper Lane that adjoins their property. The bids meet the minimum requirement established by the current Gila County policy on the abandonment of roadways in Gila County.
Evaluation
Abandoning the portions of Roper Lane will not deny anyone access to their property.
Conclusion
It is the best interest of all involved to abandon portions of the road.
Recommendation
It is the recommendation of the Public Works Department Director that the Board of Supervisors table this agenda item to allow the County Attorney's Office additional time to research and answer questions regarding this topic.
Suggested Motion
Information/Discussion/Action for the public sale of a portion of Roper Lane as shown on Verde Glen 3, Plat Map No. 393, Gila County Records, Gila County, AZ and accept bids submitted by the adjacent property owners. (Steve Sanders)
