Amendment No. 1 to Contract No. 022818-Houston Mesa Road Chip Seal to extend the contract end date to June 30, 2019.
Background Information
On May 1, 2018, the Board of Supervisors awarded Contract No. 022818 to Pima Paving for the Houston Mesa Chip Seal project.
 
On May 23, 2018, the United States Forest Service issued a full forest closure for portions of the Tonto National Forest, which included the area of Houston Mesa Road due to extreme fire danger.  Full forest closure was finally lifted on July 13, 2018.  No work was allowed on the project prior to July 13th.
 
A Notice to Proceed was issued to Pima Paving on July 30, 2018.  Per the terms of the contract, all work was to be completed within 70 calendar days from the Notice to Proceed date; therefore, October 7, 2018, was the date that all work was to be completed.  The purchase order term was established as November 30, 2018, for the end of contract date to allow for the processing of final billing.
 
All work has been completed to date; however, the chip seal application was not a complete success and will require the contractor to return to the project to perform numerous repairs.  The necessary chip seal repairs are temperature sensitive.  The surface temperature required for the repairs per the contract shall be a minimum of 85 degrees F and the ambient temperature shall be at least 65 degrees F and rising.

Pima Paving and Gila County have agreed to withhold payment of 25% of the total chip seal item amounting to $56,553 until the County accepts the needed repairs.
Evaluation
The required surface and ambient temperatures needed for the chip seal repairs will not be achieved until next spring or early summer.  By leaving the contract open until 06/30/2019, this will allow ample time for Pima Paving to return to the job site when the weather conditions are favorable for the needed chip seal repairs and then invoice Gila County for the remaining 25% of the chip seal item.
Conclusion
The Public Works Department Director would like to extend the contract date to June 30, 2019, to allow ample time next spring or early summer for Pima Paving to return to perform the needed chip seal repairs and for the processing of final billing.

Amendment No. 1 to Contract No. 022818 will serve to extend the contract term from November 15, 2018, to June 30, 2019. Further, Amendment No. 1 will serve to remove the language from the contract: ISRAEL BOYCOTT CERTIFICATION: "Contractor hereby certifies that it is not currently engaged in and will not, for the duration of this agreement, engage in a boycott of Israel as required by A.R.S. § 35-393.01. Violation of this certification by Contractor may result in action by County up to and including termination of this agreement."
Recommendation
The Public Works Department Director recommends that the Board of Supervisors approve Amendment No. 1 to extend Contract No. 022818 with Pima Paving to reflect a June 30, 2019 completion date, and remove language from the contract regarding teh Israel Boycott certification.
Suggested Motion
Approval of Amendment No. 1 to Contract No. 022818 with Pima Paving for the Houston Mesa Chip Seal project to extend the contract end date to June 30, 2019, and remove language regarding Israel Boycott certification from the contract.
