Amendment #3 to an Intergovernmental Agreement between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College.

Background Information

On April 11, 2005, the Board of Supervisors approved a Settlement Agreement, Operating Agreement, and an Intergovernmental Agreement (IGA) between Gila County; Gila County Provisional Community College District; and Graham County Community College District d/b/a Eastern Arizona College which pertain to post-secondary educational services in Gila County.

After the April 11, 2005 meeting concluded, it was discovered that meeting agenda contained a meeting start time of 10:00 p.m. rather than 10:00 a.m. Due to that error, the County Attorney's Office advised the Board to place an agenda item on the Board’s April 19, 2005 meeting to ratify the Board’s April 11, 2005 approval for the Chairman to sign the Settlement Agreement, Operating Agreement, and IGA. The agenda item was approved with a 2 to 1 vote.

On March 31, 2009, the Board approved an Amendment to the Operating Agreement to amend Article IV, paragraph 10 of the Operating Agreement.

On April 28, 2009, the Board approved an Amendment (#1) to the IGA to extend the contract for 3 years to June 30, 2018. The Operating Agreement also extended to June 30, 2018, as it provides terms and conditions related to services provided pursuant to the 2005 IGA.

On June 5, 2018, the Board approved an Amendment (#2) to the IGA to extend the term of the IGA to December 30, 2018.

Evaluation

Gila County has drafted an Amendment #3 to the 2005 IGA to extend the IGA to December 30, 2019.

Conclusion

An Amendment #3 to the 2005 IGA to extend the term of the IGA to December 30, 2019, has been drafted for the Board's review and consideration of approval.

Recommendation

The Gila County Attorney's Office recommends that the Gila County Board of Supervisors consider approving Amendment #3 to the 2005 IGA that is between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College to extend the IGA to December 30, 2019.

Suggested Motion

Approval of Amendment (#3) to the Intergovernmental Agreement (IGA) that is between Gila County Community College District (Provisional); Gila County; and Graham County Community College District d/b/a Eastern Arizona College for post-secondary educational services in Gila County, which extends the IGA to June 30, 2019.
