Approval of an Order to call a Special Election to be held on May 17, 2016, for the purpose of electing a governing board for the Solitude Trails Domestic Water Improvement District (STDWID).

Background Information

On November 22, 2015, the Gila County Board of Supervisors accepted the resignations of Mark J. Fumusa and Mark Peschman of the STDWID governing board. Pursuant to A.R.S. §48-1016, the Gila County Board of Supervisors revoked the authority of the STDWID governing board. The Board of Supervisors pursuant to A.R.S. §48-1016 shall have the option of calling for new elections for the governing Board of Directors.

Evaluation

A.R.S. §48-1016 allows for the Board of Supervisors to call a Special Election to elect governing board members for the STDWID. A Special Election can be held on the next consolidated election date pursuant to A.R.S. §16-204.

Conclusion

Based upon A.R.S. §48-1016 and A.R.S. §16-204, the Board of Supervisors can call for a Special Election to elect governing board members to the Solitude Trails Domestic Water Improvement District.

Recommendation

It is recommended that the Board of Supervisors approve the Order calling for a May 17, 2016, Special Election to elect a new Board of Directors for the Solitude Trails Domestic Water Improvement District.
