Amendment No. 1 to Intergovernmental Agreement (IGA) No. 071918 with the Town of Hayden-Building for Code Compliance and Inspection Services
Background Information
On October 2, 2018, the Board of Supervisors approved Intergovernmental Agreement No. 071918 with the Town of Hayden for code compliance and inspection services.

The Town does not have building or zoning inspectors on staff.  In order to comply with state statutes and the Town’s ordinances, in regard to fire, health and life safety, the Town requires technical assistance in the areas of inspections and code compliance.  The Gila County Community Development Department shall provide field inspections and reports to ensure compliance with state statutes and the Town’s ordinances.  The Town shall compensate the County for services provided at the rate of $50 per inspection or $50 per hour for services rendered.
Evaluation
Amendment No. 1 extends the term of the IGA for one additional year, from October 2, 2019, to October 1, 2020; and removes the language "ISRAEL BOYCOTT CERTIFICATION: Contractor herby certifies that it is not currently engaged in and will not, for the duration of this agreement, engage in a boycott of Israel as required by A.R.S. 35-393.01. Violation of this certification by Contractor may result in action by County up to and including termination of this agreement."

The Gila County Community Development Division has trained personnel with inspection and code compliance experience whereas the Town does not.  The Town is very interested in pursuing code compliance violations and with the assistance of the County, a determination can be made if there is actually a violation.  The Town will then pursue enforcement of the confirmed violations.
Conclusion
Approval of Amendment No. 1 will benefit the Town of Hayden since the County has the resources and expertise in inspections and code compliance that the Town does not. The added workload to the staff of Community Development is expected to be minimal.  Staff recommends approval of Amendment No. 1 to IGA No. 071918.
Recommendation
The Community Development Division Director recommends the approval of Amendment No. 1 to  Intergovernmental Agreement No. 071918 with the Town of Hayden-Building for Code Compliance and Inspection Services.
Suggested Motion
Information/Discussion/Action to approve Amendment No. 1 to Intergovernmental Agreement No. 071918 with the Town of Hayden to extend the contract term for an additional year to October 2, 2020, whereby the Community Development Department will continue to provide code compliance and inspection services for the Town; and remove unnecessary language from the IGA. (Scott Buzan)
