Intergovernmental Agreement (IGA) between Gila County for and on behalf of the Gila County Sheriff's Office and the Tonto Apache Tribe by and through the Tonto Apache Police Department for Law Enforcement Assistance and Mutual Aid.
Background Information
The Gila County Board of Supervisors approved the original IGA between the Gila County Board of Supervisors, Gila County Sheriff's Office, and the Tonto Apache Tribe for Mutual Aid in the event of emergency or disaster on December 15, 2009. The agreement was in effect for 5 years and may be extended for a subsequent period of time not to exceed 5 years.

This IGA will replace the original agreement approved on December 15, 2009, and it is between Gila County for and on behalf of the Gila County Sheriff's Office and the Tonto Apache Tribe by and through the Tonto Apache Police Department for Law Enforcement Assistance and Mutual Aid.
Evaluation
This IGA is entered into to provide for the orderly and effective enforcement of the criminal and traffic laws of the Tribe and County, within the Tonto Apache Indian Reservation, Indian Country as defined in 18 U.S.C. 1151; to prevent any jurisdiction from becoming a sanctuary for violators of the law of another jurisdiction; to prevent inter-jurisdictional flight; and to foster greater respect for the laws of each jurisdiction by the more certain application thereof. This IGA is also entered into to provide the authority for and define the emergency management terms and procedures that will be used by the parties for dispatching mutual aid to any affected area.
Conclusion
The IGA between Gila County and the Tonto Apache Tribe for Law Enforcement Assistance and Mutual Aid will allow the Gila County Sheriff's Office and the Gila County Department of Health and Emergency Management to provide assistance to the Tonto Apache Tribe during an emergency situation or disaster.
Recommendation
Gila County Sheriff Adam Shepherd and Michael O'Driscoll, Gila County Health and Emergency Management Department Director, recommend that the Gila County Board of Supervisors approve the IGA between Gila County and Tonto Apache Tribe for Law Enforcement Assistance and Mutual Aid.
Suggested Motion
Information/Discussion/Action to approve an Intergovernmental Agreement between Gila County, for and on behalf of the Gila County Sheriff's Office, and the Tonto Apache Tribe, by and through the Tonto Apache Police Department, for Law Enforcement Assistance and Mutual Aid for a period of three (3) years from the date of signing.
