Approval of Amendment No. 3 to Professional Services Contract No. 040815 - Raymond Geiser.

Background Information

On June 9, 2015, the Board of Supervisors approved Professional Services Contract No. 040815 with Raymond Geiser, whereby Raymond Geiser will provide legal services for indigent citizens as appointed by the Superior Court in Gila County for a period from July 1, 2015, to June 30, 2016. The original contract was executed for a not to exceed, without written authorization, amount of $140,643.

On July 5, 2016, the Board of Supervisors approved Amendment No. 1 to Professional Services Contract No. 040815 to increase the contract amount to $154, 643.

On August 2, 2016, The Board of Supervisors approved Amendment No. 2 to Professional Services Contract No. 040815, which renewed the contract for one additional year beginning July 1, 2016 to June 30, 2017; decreased the contract amount to $135,643; and, added the sentence "In the event of formal discipline of the Attorney by the State Bar of Arizona, the Court may suspend or terminate the contract".

Evaluation

The Gila County Superior Court would like to increase the amended contract amount to cover the 5% increase received by attorneys in Fiscal Year 2015.

Amendment No. 3 has been issued to increase the contract amount by an additional $3,488.16 for an amended contract amount of $139,131.16 to cover the 5% Fiscal Year 2015 increase; and to add the following language: Contractor hereby certifies that it is not currently engaged in, and will not, for the duration of this agreement engage in, a boycott of Israel as defined by A.R.S.§35-393.01. Violation of this certification by Contractor may result in action by County up t and including termination of this Agreement.

Conclusion

Court Administration has requested an increase to Professional Services Contract No. 040815 with Raymond Geiser to cover the increase received by attorneys in Fiscal Year 2015 .

Recommendation

It is the recommendation of Court Administrator Jonathan Bearup to increase Professional Services Contract No. 040815 with Raymond Geiser to cover the 5% increase received by attorneys in Fiscal Year 2015 .

Suggested Motion

Approval of Amendment No. 3 to Professional Services Contract No. 040815 between the Superior Court in Gila County and Raymond Geiser to increase the contract amount by $3,488.16 for an amended contract amount of $139,131.16 to cover the 5% increase received by attorneys in Fiscal Year 2015.
