Approval of an Intergovernmental Agreement No. 090514 with Town of Payson for Pre-Annexation.
Background Information
On January 19, 2010, the Gila County Board of Supervisors approved entering into an Intergovernmental Agreement (IGA) with the Town of Payson, whereby both Gila County and the Town of Payson are responsible for (a) the design and construction compliance of its public buildings and other structures within the territorial jurisdiction of the other Party, in accordance with the constructing Party's construction codes; (b) the issuance of all applicable permits; and (c) the inspection of such buildings and other structures.

The term of the IGA began from the date the IGA was recorded, to June 30, 2014.  The IGA expired on June 30, 2014.
Evaluation
The Town of Payson, pursuant to  A.R.S. §9-240 and Title 9, Chapter 7, Article 1, Arizona Revised Statutes, and the County, pursuant to A.R.S. §11-861, et seq., are authorized to regulate the quality, type of material and workmanship of all aspects of building construction and to adopt uniform codes regulating such construction in their jurisdictional territory. 

The IGA establishes jurisdictional authority for compliance with building and development codes for public property owned by each jurisdiction in the other's jurisdictional territory.  The IGA allows Gila County to follow its own rules and codes on its property within the town limits of Payson, and allows the Town of Payson to follow its rules and codes on its property outside of the city limits in the County.
Conclusion
By executing this IGA to replace the June 30, 2014, expired IGA, the practice of each entity regulating their public property within each other's jurisdictional territory can remain ongoing.
Recommendation
Staff recommends authorizing the Chairman's signature on Intergovernmental Agreement No. 090514 with the Town of Payson, to continue the practice of each entity regulating the construction of public property within each other's jurisdictional territory.
Suggested Motion
Approval of an Intergovernmental Agreement (Agreement No. 090514) with the Town of Payson for pre-annexation to allow each entity to regulate public property within each other's jurisdictional territory commencing on July 1, 2014, and automatically renewing from year to year, unless terminated sooner by either party giving 30 days' prior written notice to terminate.
