Intergovernmental Agreement No. 030614 - Town of Star Valley for Consolidated Administration and Operation of Limited Jurisdiction Courts.

Background Information

Since 2006, the Town of Star Valley has utilized the Payson Regional Justice Court to serve as the Star Valley Magistrate Court. On February 3, 2009, the Gila County Board of Supervisors approved an Intergovernmental Agreement (IGA) between the Town of Star Valley and Gila County for the consolidated administration and operation of limited jurisdiction courts as a means for the Town to compensate Gila County for the space utilized by the Magistrate Court to conduct Town business, and to provide compensation for the costs associated with the Magistrate Court utilizing Gila County facilities, personnel, equipment, supplies and overhead for the operation of the Magistrate Court.

The initial term of the IGA was from January 1, 2009, to June 30, 2013.

Evaluation

Pursuant to IGA No. 030614, the Town of Star Valley agrees to pay 24% of the total budget for the Payson Regional Justice Court, minus judicial salaries. The percentage paid by the Town of Star Valley will be reviewed annually beginning each January and amended each April 1 thereafter.

Conclusion

With the approval of Intergovernmental Agreement No. 030614, the County will be able to accurately invoice and receive payment from the Town of Star Valley for the costs associated with the Magistrate Court utilizing Gila County facilities, personnel, equipment, supplies and overhead for the operation of the Magistrate Court for Town of Star Valley business.

Recommendation

Staff recommends that the Board of Supervisors approve entering into Intergovernmental Agreement No. 030614 - Consolidated Administration and Operation of Limited Jurisdiction Courts, with the Town of Star Valley.

Suggested Motion

Approval of Intergovernmental Agreement No. 030614 - Consolidated Administration and Operation of Limited Jurisdiction Courts in order to provide a means for compensation from the Town of Star Valley to Gila County for the costs associated with the Magistrate Court utilizing Gila County facilities, personnel, equipment, supplies and overhead for the operation of the Magistrate Court to conduct Town of Star Valley business for the term beginning July 1, 2013, through June 30, 2017.
