Background Information

A.R.S. 41-2421 - Enhanced collections; allocation of monies; criminal justice entities. Five percent of any monies collected by the Supreme Court and the Court of Appeals for the payment of filing fees, including clerk fees, diversion fees, fines, penalties, surcharge, sanctions and forfeitures shall be deposited and allocated by the Gila County Treasurer. Once the Board of Supervisors certifies the annual collection and it does not exceed the base year amount, the 5% set aside monies will be distributed back to the original allocation recipient proportionately to their percent of total collections.

Evaluation

Reports turned into the Treasurer's Office by the Superior Court, Globe Regional Justice Court and the Payson Regional Justice Court total the annual collections of $2,411,868.94 and is presented by the Gila County Treasurer to the Board of Supervisors for certification. With the annual collection not exceeding the base year amount, once certified by the Board of Supervisors the 5% set aside monies $111,172.09 will be distributed back to the original allocation recipient proportionately to their percent of the total collections.

Conclusion

The Finance Department recommends that the Board of Supervisors certify the Fiscal Year 09-10 annual collection.

Suggested Motion

Approval to certify the “Fill the Gap” funds per A.R.S. §42-2421 (G) for the Treasurer’s Office FY 2009/2010 annual collections by the following: Superior Court $811,904.01; Payson Regional Justice Court $720,505.52; and Globe Regional Justice Court $909,459.41 for a total of $2,441,868.94. The 5% Proportion T-895 is $111,172.09.
